Welcome to JM Learns
JM Learns ("we," "us," "our") is an interactive e-learning platform operated by Joytek Motion Ltd. By creating an account, enrolling in a course, or otherwise using our services, you agree to these Terms of Service in full.
If you disagree with any part of these terms, do not use our platform.
Age Requirement
Our platform is available to users aged 13 and above. Users between the ages of 13 and 17 must have the verifiable consent and ongoing supervision of a parent or legal guardian before creating an account or enrolling in any course.
We require parental involvement for minors because our platform involves:
- Online interactions with tutors and other students through live video classes and course discussions
- Payment processing, which requires the submission of financial information
- Personal data collection, including names, contact details, date of birth, and learning records
- Assessment and performance tracking, which generates records about a child's academic progress
- Scheduled live sessions, which benefit from parental awareness of a child's online activities and commitments
Nigerian law (including the Child Rights Act) and international child protection standards (including COPPA principles) recommend or require parental involvement for minors engaging in online services that collect personal data or involve financial transactions. By allowing a minor to register, the parent or guardian confirms they consent and agree to be responsible for the minor's activity on the platform.
We reserve the right to terminate any account we have reason to believe is operated by a user under 12, or by a minor without appropriate parental consent.
Our Services
JM Learns provides:
- Cohort-based online courses taught by independent tutors
- Live classroom video sessions
- Course assessments and quizzes
- Downloadable course resources and materials
- Tutor-led learning experiences across various subjects
Tutors on JM Learns are independent professionals, not employees of Joytek Motion Ltd. We provide the platform infrastructure; tutors are responsible for their course content, delivery, and accuracy.
Your Account
Your Responsibilities
You are responsible for:
- Providing accurate and truthful account information
- Maintaining the security of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
Account Suspension and Termination
Termination by You: You may close your account at any time by contacting support. Closing your account does not entitle you to refunds for prior enrollments unless a refund is otherwise due under our Refund Policy.
Termination by Us: We reserve the right to suspend or terminate accounts immediately, without prior notice, for:
- Violation of these Terms of Service
- Fraudulent activity or misrepresentation
- Harassment of tutors, students, or staff
- Filing frivolous or fraudulent chargebacks
- Using the platform for illegal purposes
- Any conduct we determine is harmful to the platform or its users
Upon termination: account access is revoked, access to course content is denied, and outstanding payments remain due. Your data will be handled in accordance with our Privacy Policy.
You may appeal a termination by contacting [email protected] within 30 days.
Enrollments and Course Access
When you enrol in a course, you receive access to the course content for the duration specified at enrollment. This is a personal, non-transferable license to access the content — you may not share your login credentials or grant others access to your enrolled courses.
Tutors may update or modify course content. We do not guarantee that course content will remain identical after enrollment, though substantive changes to a course that significantly diminish its value may be grounds for a refund at our discretion.
Tutor Payouts
Revenue Split
JM Learns retains a 20% service fee on each enrollment payment. Tutors receive 80% of each course enrollment payment as their earnings. This fee covers platform infrastructure, payment processing, security, and support services.
Refund Window and Fund Holding
After a student pays for a course, the corresponding tutor earnings are held in a pending state during the refund window. The refund window is 3 days after the course start date. This protects students and ensures that funds are not released to tutors before the refund eligibility period has expired. Once the refund window closes without a refund being requested, the funds are released to the tutor's available balance.
Bank Account Requirements
To receive payouts, tutors must add and verify at least one Nigerian bank account to their JM Learns account. Tutors may have up to 3 bank accounts registered, with one designated as the default payout account. Bank account details are verified through Paystack before payouts can be processed.
Requesting Payouts
Tutors may request a payout of their available balance at any time. Payouts are processed via Paystack bank transfers to the tutor's verified default bank account. Payout requests are subject to review and processing time.
Available Balance Calculation
A tutor's available balance is calculated as:
Total earned from completed enrollments, minus funds pending release (still within refund window), minus refunded amounts, minus amounts already paid out.
Only funds that have passed the refund window are included in the available balance. Tutors cannot request payout of funds that are still in a pending release state.
Platform Rights
We reserve the right to withhold, adjust, or reverse tutor payouts in cases of fraud, chargebacks, disputed transactions, policy violations, or where required by law. We will notify tutors of any such action and provide an opportunity to respond.
Tax Responsibilities
Tutors are solely responsible for declaring and paying any applicable taxes on their earnings from JM Learns. Joytek Motion Ltd does not withhold taxes on tutor earnings unless required to do so by applicable Nigerian law.
Payments
All payments on JM Learns are processed securely via Paystack. Prices are displayed and charged in Nigerian Naira (NGN). Charges will appear as Joytek Motion Ltd on your bank or card statement.
You agree to pay all applicable fees at the time of enrollment. We reserve the right to update course prices; however, existing enrollments are not affected by price changes.
Refunds
JM Learns operates a tiered refund policy based on the timing of your refund request relative to the course start date. For full details, see our Refund Policy.
In summary: refunds before a course starts carry a 5% processing fee; partial refunds are available within 48 hours of a course starting; and no refunds are available after the 3-day refund window has closed.
Intellectual Property
All platform code, design, trademarks, and branding are owned by Joytek Motion Ltd. Course content is owned by the respective tutors who created it. Your enrollment does not transfer any intellectual property rights to you.
You may not copy, reproduce, distribute, or create derivative works from course content without the explicit written consent of the tutor and Joytek Motion Ltd.
Disclaimer of Warranties
Our platform and services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee the accuracy or quality of course content provided by tutors.
Some jurisdictions do not allow exclusion of implied warranties, so the above exclusion may not fully apply to you.
Limitation of Liability
To the maximum extent permitted by law, Joytek Motion Ltd's total liability for any claim shall not exceed the amount you paid for the specific course giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages, lost profits, or business interruption — even if we were advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless Joytek Motion Ltd and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
Dispute Resolution
Before initiating formal proceedings, you agree to contact us at [email protected] and attempt to resolve any dispute informally for at least 30 days.
Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes that cannot be resolved informally shall be submitted to the courts of Nigeria. If you are a consumer, you may also have rights under the laws of your country of residence that cannot be waived by contract.
Changes to These Terms
We may update these terms at any time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.
Severability
If any provision of these terms is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions continue in full effect.
